Law Enforcement Guidelines
Last updated: September 25, 2026
These guidelines are for law enforcement and government agencies seeking information about users of the Exchange app and website (the "Service"). The Service is operated by Exchange Social App, LLC, a North Carolina limited liability company. These guidelines are not legal advice and do not create rights for any person.
1. How to submit a request
Send requests by email to legal@exchangesocialapp.com from an official government email address. Please include:
- The legal process (subpoena, court order or search warrant) as a PDF, signed and issued by the appropriate authority.
- The requesting agency, officer name, badge or ID number, and a callback phone number.
- The account identifiers you are asking about, such as the user ID, profile name or email address, and the specific records and date range requested.
We do not accept requests through the app, social media or general support channels.
2. Legal process we require
We disclose user records only in accordance with applicable law, including the U.S. Stored Communications Act (18 U.S.C. § 2701 et seq.):
- Subpoena: basic subscriber information, such as the email address used to register, account creation date and recent sign-in IP addresses.
- Court order under 18 U.S.C. § 2703(d): additional non-content records, such as account activity logs.
- Search warrant: stored contents, such as messages, photos and albums.
We review every request and may object to requests that are overbroad, unclear or legally deficient.
3. Preservation requests
We honor preservation requests under 18 U.S.C. § 2703(f). On receipt of a valid request, we will preserve a one-time snapshot of the identified account's records for 90 days while you obtain formal legal process. The preservation may be extended once for an additional 90 days on request.
4. Emergency requests
If you believe there is an emergency involving imminent danger of death or serious physical injury, email legal@exchangesocialapp.com with "EMERGENCY" in the subject line. Describe the emergency, explain how the requested information will help prevent the harm, and identify the account. We may voluntarily disclose information in good faith under 18 U.S.C. § 2702(b)(8) and (c)(4).
5. Requests from outside the United States
Exchange is a U.S. company. Non-U.S. agencies should seek user records through a Mutual Legal Assistance Treaty (MLAT), letters rogatory or another process recognized under U.S. law. We may respond to emergency requests from non-U.S. agencies as described above.
6. User notice
Our policy is to notify users of requests for their information before disclosure, unless we are prohibited from doing so by law or court order, or if notice would be futile or create a risk of harm to a person.
7. Child safety
We use hash-matching technology to detect known child sexual abuse material and report apparent violations to the National Center for Missing & Exploited Children (NCMEC) as required by 18 U.S.C. § 2258A. Reported material is preserved as required by law. Agencies seeking records related to a CyberTipline report should reference the CyberTipline report number in their request.
8. What we may have
Depending on the account and our retention periods, records may include registration details, profile information, photos, messages, approximate and device-reported location, and sign-in IP addresses. Verification ID images and selfies are deleted after review is complete, and deleted accounts are removed or de-identified except where the law requires retention. We may not have the records you request.
