Copyright and DMCA

How to report copyright infringement on Exchange, how to respond if your content was removed, and our repeat-infringer policy, under the DMCA, 17 U.S.C. § 512.

Reporting infringement

Send a written notice to our Designated Copyright Agent that includes all of the following (17 U.S.C. § 512(c)(3)):

  1. A physical or electronic signature of the copyright owner or a person authorized to act for them.
  2. Identification of the copyrighted work claimed to be infringed, or a representative list.
  3. Identification of the material claimed to be infringing, with enough detail for us to find it.
  4. Your name, mailing address, telephone number and email address.
  5. A statement that you have a good-faith belief the use is not authorized by the owner, its agent or the law.
  6. A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner.

Under § 512(f), knowingly misrepresenting that material is infringing can make you liable for damages.

What we do

When we receive a compliant notice, we act quickly to remove or disable access to the material and make a reasonable attempt to notify the member who posted it, with a copy of the notice.

Counter-notification

If your content was removed and you believe it was a mistake or misidentification, send our Copyright Agent a written counter-notification containing (17 U.S.C. § 512(g)(3)):

  1. Your physical or electronic signature.
  2. Identification of the removed material and where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
  4. Your name, mailing address and telephone number, a statement that you consent to the jurisdiction of the federal district court for your district (or, if outside the U.S., any district where we may be found), and that you will accept service of process from the person who filed the original notice.

If we receive a valid counter-notification, we may restore the material in 10 to 14 business days unless our Agent first receives notice that the complaining party has filed a court action.

Repeat infringers

Consistent with § 512(i), we will, in appropriate circumstances, disable or terminate the accounts of repeat infringers.
